General Terms and Conditions for tuition at Malmö Musikskola — version v2026-10

These Terms apply to new agreements entered into from the day this version is published, 28 September 2026, and to agreements entered into earlier from the day the contracting party accepts these Terms in the portal, which is possible from the day this version is published (§ 14). If the contracting party does not accept them, the agreement continues on its previous terms (14.4). The version you accepted is always available in the portal and in your agreement confirmation.

§ 1 Who the agreement is between

1.1 The School is Malmö Musikskola AB, company registration number 559315-8917, Sarvgränd 1B, Limhamn, Sweden, e-mail info@malmomusikskola.se. The same address is used for questions about the agreement, for notices that you withdraw from the agreement (§ 15) and for personal-data matters (§ 17).

1.2 The contracting party is the person who enters into the agreement and accepts these Terms: the guardian of the student, or the student if the student is 18 or older. A guardian may also be the contracting party for a student who is 18 or older (2.6). By entering into the agreement you confirm that you are the guardian of the child the agreement concerns, or that you are the adult student. The School verifies your identity with BankID; guardianship is declared by you, exactly as on the School's previous form.

1.3 If it later turns out that the person who entered into the agreement was not the child's guardian, the agreement is annulled: no lessons are counted, no fee is charged and fees already paid are refunded. A new agreement can be entered into by the right person.

1.4 If the student has two guardians, the one who entered into the agreement is the contracting party and the one who can terminate or change the agreement. The other guardian is informed of the signing, of termination and of other agreement events.

1.5 The payer is the contracting party. The person paying by card need not be the contracting party — the card is registered on the contracting party's account with the School. If you pay by invoice, the School can on request name another invoice recipient (for example an employer) on the invoice; the contracting party remains responsible for payment. The buyer of a gift card (§ 13) is neither contracting party nor payer and has no access to the student's information.

1.6 One agreement per subject. If the student studies several subjects, each subject is a separate agreement with its own credits and its own saved lessons. If you pay by invoice, the agreements are combined on one invoice.

1.7 The agreement is with the School, not with an individual teacher. The School decides which teacher gives the tuition and may let another teacher give a lesson or change teacher or premises. A change of teacher does not give a right to terminate the agreement without a fee during a commitment period. If you pay a supplement for a named teacher and the School permanently changes the regular teacher, the supplement is removed from the next fee; temporary substitutions do not affect the price. If the School changes the premises, the weekday or the time so that the student cannot take part, 9.6 applies. If, however, the School cannot offer any teacher at all in the subject, or closes down, § 10 applies.

§ 2 What you buy

2.1 You buy a place: tuition on a fixed day and time every teaching week according to the School's teaching calendar, shown in the portal. The annual fee is divided into twelve equal months; tuition is given during the School's 40 teaching weeks. The number of teaching weeks is the School's current value and is shown in the teaching calendar. The monthly fee is therefore the same also in months without tuition — it is one twelfth of the annual fee, not a price for that month's lessons.

2.2 The number of lessons per agreement year — currently 40 for one lesson a week and 20 for one lesson every other week — is stated in your agreement confirmation and is information about the planning, not a promise of a fixed number of completed lessons. The number changes only if the agreement is changed (3.4). In the portal you always see, for the current agreement year: how many lessons are planned, how many the School has cancelled, how many have been delivered so far, and how many saved lessons you have and how long they are valid ("x of y lessons this year"). Moving or saving a lesson, or not attending it, does not change the number of planned lessons and never counts as cancelled by the School; if you move or save a lesson, § 7 applies. If the teaching calendar plans fewer lessons than the agreement's number, the School corrects it, or records the difference at the end of the agreement year as lessons cancelled by the School (2.4).

2.3 Every lesson is shown in the portal with start and end time (for example 10:00–10:30). All dates and time limits in these Terms are counted in the School's local time (Swedish time), wherever you are.

2.4 A lesson cancelled by the School — because of teacher absence, a closed day or another reason on the School's side — does not count as delivered. The value of the lesson is placed on the agreement as a saved lesson without any credit being deducted, and you are offered a new time with priority. Such a lesson is valid for the life of the agreement — it does not expire at the end of the agreement year (7.6). What happens to it when the agreement ends is stated in 7.8 and § 11.

2.5 Groups and ensembles. A place in a group or ensemble has a fixed monthly fee per participant, regardless of how many take part. Absence is reported in the portal. Reported absence from a group session gives, as a rule, neither a saved lesson nor a credit; if something else applies to your group, it is stated in the agreement confirmation. The group's day and time are changed only by the School. A group starts when the minimum number of participants have enrolled, and payment begins only then. If the group does not reach the minimum number it does not start: the agreement is annulled without a fee, and a fee already paid is refunded.

2.6 Adult students have the same Terms as children. A student who is 18 or older is the contracting party — or a guardian may be the contracting party and payer for the student, if the student and the guardian so wish. The student turning 18 does not change the agreement by itself; if the student wishes to take it over, 3.5 applies.

2.7 Offer from the School. After you have spoken to the School's front office, the School can send you an offer of an agreement in the portal, instead of you signing up on the website. The offer is valid up to and including the date stated in it; the School may remind you before it expires and may extend the time once. The offer is the School's proposal — nothing binds you until you have accepted these Terms with BankID in the portal. The price in the offer applies if you accept in time, even if the School's price list changes in the meantime; the Terms you accept are those in force on the day you accept. If the School has reserved a lesson time for you, it is held up to and including the last day. When you accept you register a card (§ 6) — or choose, if the offer allows it, payment by invoice; the School then makes a credit check before invoice payment is approved and stores only the outcome and the date (17.6). If you do not accept in time the offer lapses at no cost, and the School may send a new one. An offer once sent is not changed — if the School wants to change something it sends a new offer that replaces the old one. You can decline an offer in the portal. An agreement entered into through an offer follows these Terms in all other respects, including the right of withdrawal in § 15.

§ 3 Agreement year, commitment period and service period

3.1 The agreement year is twelve months counted from the student's first lesson day. It is a rolling year that is personal to each agreement — not a calendar year. The monthly fees are numbered 1 to 12 within the agreement year ("fee x of 12"). A new agreement year begins automatically when the previous one ends, unless the agreement has been terminated.

3.2 The service period of your agreement is the current agreement year: from the first lesson day to the day before the same date twelve months later. Lessons are given up to and including the last lesson day stated when the agreement ends (§ 8–§ 10). Both dates and the number of lessons (2.2) are stated in your agreement confirmation and in the portal.

3.3 Agreement forms and commitment period. The School offers the agreement in two forms. Which form you have is stated in your agreement confirmation:

– Committed agreement — 12 months, two calendar months' notice. An offer with a commitment period gives a lower price and/or credits and other benefits according to the price list. The School's current offer with commitment runs for twelve months from the first lesson day. – Open-ended agreement — two calendar months' notice. The agreement runs until you or the School terminate it.

If you give notice on a committed agreement no later than two calendar months before the last day of the commitment period, the agreement ends on that day (8.2). If you do not give notice, the agreement continues as an open-ended agreement at the School's ordinary price — it is never automatically extended with a new commitment period. The ordinary price applies from the day after the last day of the commitment, in the way stated in 4.3; the agreement year and the count "fee x of 12" continue unchanged. The School reminds you about 30 days before the last day on which you can give notice for the agreement to end when the commitment expires (8.2), with the choice to continue or to end. An agreement that has continued as open-ended has the number of credits of the open-ended agreement form (the School's current value: 0).

3.4 Changing the agreement. If you want to change agreement type you request it in the portal; the School carries out the change and first shows you what it means. The change takes effect on a set day, with a new agreement taking over from the old one. The agreement year continues unchanged, and the credits in the pool follow. There are two kinds of change:

– A change that keeps the lesson form (the same lesson length and the same number of lessons per year — for example between a committed and an open-ended agreement, or to another price list): no settlement is made, the count "fee x of 12" continues, your saved lessons follow to the new agreement, and the new price applies from the first fee issued on or after the day of the change. – A change of lesson form (another length or another number of lessons per year, for example from 30 to 45 minutes): the old agreement is settled up to the day of the change — paid lessons (the number of paid fees times lessons per year, divided by twelve) against delivered lessons, at the old agreement's lesson value — and the difference is placed as a line on the new agreement's first fee; as long as the agreement continues nothing is paid out. Saved lessons do not follow as minutes: the value of lessons cancelled by the School is credited on the new agreement's first fee, while lessons you saved yourself lapse on the day of the change (the School's current value) unless the School allows otherwise.

A change may be made also during a commitment period. A change to a shorter commitment period, to an open-ended agreement, to a shorter lesson or to fewer lessons per year requires the School's consent; a change to the same or more is free. If you change from an open-ended to a committed agreement, a new commitment period begins on the day of the change; if you change between committed agreements, the old commitment period continues. A change gives no new withdrawal period (the School's current value) and is never a termination. A change of weekday or time is a schedule change, not a change of agreement.

3.5 Change of contracting party. A student who turns 18 can take over the agreement — but need not: until the student, the guardian and the School have approved a takeover, the guardian is the contracting party and payer, and the agreement continues unchanged. The School may make a credit check before approving, and then stores only that the change was approved and when. In the event of separation or similar, the agreement can be transferred to the other guardian in the same way. The agreement's history is not changed, and invoices already sent stay with the previous contracting party.

3.6 Change of course or subject. By agreement with the School, the student may change course or subject during the term of the agreement. The agreement continues unchanged — the commitment period, the notice period and the credits are not affected — and the price follows the price list for the new course from the first fee issued on or after the day of the change. If the change means a different lesson length or a different number of lessons per year, the rules for changing the agreement in § 3.4 apply instead.

§ 4 Prices and price changes

4.1 The price of your agreement is shown in the School's price list when the agreement is entered into and is frozen on the agreement: it is not changed by later price lists, changes of teacher or campaigns during the agreement year. On a committed agreement the price is frozen for the whole commitment period. On an open-ended agreement the price may be changed under 4.3, and then always with at least the notice period's warning, so that you have time to terminate the agreement before the new price starts to apply. All prices are stated including VAT.

4.2 For agreements with monthly payment, the monthly fee is the annual fee divided by twelve. The lesson value is the annual fee divided by the number of lessons per agreement year; it is used when an agreement is settled (§ 11) and when a credit is bought (§ 7.4). Example with the School's current price list: 30 minutes a week on an open-ended agreement costs SEK 1,639 per month, that is SEK 19,668 per agreement year, and the lesson value is SEK 491.70.

4.3 Price change. The School may change its price list. A price change is notified to you at least two months before it starts to apply to your agreement, with the new amount for your agreement, the day it starts to apply and the last day to give notice. For an open-ended agreement the new price starts to apply on the first day of the month following two full calendar months counted from the month the notice arrived (the School's current value): if the notice arrives in September, the new price applies from 1 December. If you give notice no later than the last day of the month the notice arrived, the agreement ends before the new price starts to apply. For a committed agreement the price is never changed during the commitment; the new price applies from the day after the last day of the commitment (3.3). If you receive the notice after your last day for notice before the end of the commitment, you may still, within 14 days of the notice, terminate the agreement so that it ends on the last day of the commitment period — the School then accepts the shorter notice period. The new price is charged from the first fee issued on or after the day it starts to apply — no month is split, and the count "fee x of 12" continues. The agreement year is not affected by a price change. For agreements entered into before these Terms, § 14.3 also applies.

4.4 The School may grant a discount in individual cases; it is then stated in the agreement confirmation or on the invoice. If the School grants a break (a freeze) in the tuition, the break does not affect such a discount — it applies unchanged when the agreement is resumed.

§ 5 Trial lesson

5.1 A trial lesson is booked and paid in advance by card. The price per lesson length (30, 45 or 60 minutes) is shown in the price list. The trial lesson is given on a set day and time; the right of withdrawal therefore does not apply to the purchase, and this is stated before you pay (15.4).

5.2 After the trial lesson you receive an offer of an agreement. If you enter into an agreement within 30 days after the trial lesson (the School's current value), the price of the trial lesson is deducted from the first monthly fee. The deduction can be used once per trial lesson.

5.3 If the chosen time is no longer available when the payment is registered, the School contacts you about a new time. If no new time suits you, the payment is refunded.

§ 6 Payment, fees and late payment

6.1 New agreements are paid by card or by another automatic payment method that the School offers in the portal, for example direct debit (autogiro) or Swish. The payment method is registered when the agreement is entered into or when you accept an offer from the School (2.7). Card details are handled by the School's payment provider Stripe and are never stored by the School. Payment by invoice for a new agreement is granted by the School only when the whole agreement year is paid in advance (6.8), in an offer after a credit check (2.7); 6.4 then applies.

6.2 First and following charges. The first monthly fee is charged no later than 48 hours before the first lesson. If the agreement is entered into less than 48 hours before the first lesson, the fee is charged immediately. Thereafter the fee is charged on the same day every month — the charge day is stated in the agreement confirmation. If a shorter month lacks the charge day's date, the fee is charged on the last day of the month. The fee is paid in advance for the coming agreement month. Until the first payment has been approved the agreement has the status "awaiting payment"; the place is held for the student in the meantime.

6.3 If the first charge fails you receive a reminder to change card. If the payment has not been approved before the first lesson, the School instead sends an invoice by post or e-mail with an invoice fee according to 6.4. Tuition is never cancelled automatically because of a failed charge.

6.4 Payment by invoice or direct debit (autogiro) (agreements entered into before these Terms, and agreements where the School has granted invoice payment under 6.1). The invoice is created on the 15th and is due on the 27th of the month. It concerns fee number x of 12 in the agreement year, not a particular calendar month: the first invoice arrives after tuition has started and the last after the agreement has ended. For payment by invoice the School charges an invoice fee of SEK 49 per invoice (the School's current value, according to the price list). For payment by direct debit no invoice fee is charged; the direct debit is drawn on the due date, the 27th. You sign the direct-debit mandate through your bank. Which payment methods apply from 1 January 2027 to agreements entered into before these Terms is stated in § 14.2.

6.5 Receipt and invoice are provided by the payment provider (card payment) or the School's invoicing system (invoice and direct debit). Amounts on invoices are rounded to whole kronor.

6.6 If you do not pay on time.

– For card payment, new charge attempts are made automatically. – 14 days after the due date the School sends a reminder and charges a reminder fee of SEK 60, the amount permitted by the Swedish Act on compensation for debt-collection costs. The fee is charged on the basis of this clause. – 30 days after the due date new bookings are blocked on the agreement: rescheduling, make-up lessons and credit purchases cannot be made until the debt is paid. Tuition continues — no lesson is cancelled because of an unpaid fee, and the School contacts you. – If payment continues to be outstanding, the School may send a debt collection demand (fee SEK 180) and apply for an order to pay with the Swedish Enforcement Authority (Kronofogden) (application fee SEK 300 and representative's cost SEK 380). The amounts are those permitted by law when these Terms are written. The School is entitled to late payment interest under the Swedish Interest Act (the reference rate plus eight percentage points) from the due date. Debt collection and orders to pay are always a decision made by a person at the School — never automatic. – The School may terminate the agreement for non-payment under § 10. If this happens during a commitment period, the School is entitled to the buy-out fee in § 9.2, not to the whole remaining commitment period.

6.7 Credit purchases and gift cards are always paid by card, even if your agreement is paid by invoice or direct debit. During a payment block (6.6) no credits can be bought.

6.8 A whole year in advance. Instead of paying every month you can pay a whole agreement year in advance. The annual fee is then twelve monthly fees — neither a surcharge nor an extra discount. Payment for a whole year can be chosen for committed agreements, and is the only case in which the School grants invoice payment for a new agreement (6.1). If the agreement ends early, § 9 and the settlement in § 11 apply.

6.9 Optional extras. In addition to the tuition you can choose:

– Instrument hire — for example a violin for SEK 150 per month (the School's current value according to the price list). The hire charge is placed on the same invoice or charge as the fee. The instrument is returned when the agreement ends, and any deposit is settled then. – Sheet music and books that the School buys for the student. The cost is placed on the invoice with a mark-up of 6 per cent on the School's purchase price including VAT.

Optional extras are chosen when you enrol the student, or later in the portal, and the prices are shown in the price list. An optional extra is not part of the tuition agreement: it can be ended separately, and it affects neither the commitment period nor the notice period.

§ 7 Rescheduling, absence, credits and saved lessons

7.1 When you cancel a lesson you choose, in the same step, one of two options: move the lesson to a new time, or save it to make up later. It is not possible to cancel without choosing. The portal shows what the choice costs before you confirm.

7.2 The ladder. What a move or a save costs depends on how long before the lesson's start time you do it. The School's current limits for agreements under these Terms are 7 days and 24 hours; the limits that apply to your particular agreement are stated in the agreement confirmation.

At least 7 days before the lesson: move to a new time — free, as many times as you wish; save for later — 1 credit. Less than 7 days but at least 24 hours before the start of the lesson: move to a new time — 1 credit; save for later — 1 credit. Less than 24 hours before the start of the lesson: the lesson can no longer be moved or saved, and counts as used.

Within the last seven days, up to 24 hours before the lesson, a credit is therefore always required — one you have left in the pool, or one you buy (7.4); the last 24 hours are closed. If you have no credit and decline the purchase, the lesson stands; if you do not attend, it counts as used. If you report absence without moving or saving the lesson, it is recorded as Reported absence and counts as used. Unreported absence always counts as a used lesson. A lesson that has already started or passed is changed only by the School. When you move a lesson you choose an available time shown in the portal in your teacher's calendar; the School may offer another teacher. If you move a lesson several times, each move is tested against the start of the lesson time current at that moment. The portal always shows the step before you confirm: "Free move", "Costs 1 credit (you have n left)", "Costs 1 credit — buy for SEK X" or "Too late — the lesson counts as given".

7.3 Credits (the pool). The number of credits per agreement year is stated in your agreement confirmation. The School's current values for new agreements: 4 credits per agreement year for committed agreements, 0 for open-ended agreements. Agreements entered into before these Terms have no credits in the pool; a credit is bought when needed (7.4). If you change agreement type (3.4), the new type's number applies. The pool is refilled when a new agreement year begins. Allocated credits that have not been used when the agreement year ends lapse and are not compensated in money. A credit you have bought (7.4) is instead valid for twelve months from the purchase (the School's current value) and carries over the turn of the agreement year; the School always uses the credit that expires first. When the agreement ends all credits, including bought ones, lapse without refund. Credits and saved lessons belong to a particular agreement and cannot be moved to a sibling or to another agreement.

7.4 Buying a credit. If you need a credit and the pool is empty, you are offered to buy one for 65 per cent of the lesson value (the School's current value). The purchase is paid by card. If you decline the purchase and neither move the lesson nor attend it, it counts as used. If the payment is registered only after the lesson has started, the credit is placed in the pool and the lesson counts as given; you are informed of this.

7.5 Saved lessons. A saved lesson is shown in the portal as, for example, "1 saved lesson (45 min)". Its value is the lesson's minutes times the agreement's minute price, which is frozen on the agreement. You make it up by booking an available time in the portal, as a rule with your teacher; the School may offer another teacher. If you make up a shorter lesson than the saved one (for example 30 minutes of 45), you choose whether the remainder is saved or given up. A make-up lesson that is longer than the saved lesson requires that you have further saved value covering the difference — extra minutes cannot be bought. The School may offer that saved value is made up as an extension of coming ordinary lessons (two times 15 minutes); the value is then deducted from what is saved. If you look for a time to make up a saved lesson and none suits you, the School records your search and reminds you when new times become available — so that you do not have to watch the calendar yourself.

7.6 How long saved value is valid. Lessons you have saved yourself are valid to the end of the agreement year — up to and including the last day of the agreement year. They are never carried over to the next agreement year (the School's current value: no grace period after the end of the agreement year) and are not paid out in money. Lessons cancelled by the School (2.4), on the other hand, are valid for the life of the agreement and carry over the turn of the year; in the portal you see which applies to each saved lesson. Saved lessons cannot be used to pause the agreement: the fees run as usual until the agreement has been terminated.

7.7 A make-up lesson you do not attend counts as used. A make-up lesson cancelled by the School returns the value to the saved lesson once, so that you can book again — never twice.

7.8 A lesson cancelled by the School (2.4) is saved without any credit being deducted, and you are offered a new time with priority. If you have not had time to make up such a lesson when the agreement ends, its value becomes a credit balance (§ 12) on the final settlement (§ 11), which you can ask to have paid out — regardless of whether the lesson was cancelled during the current or an earlier agreement year. If you change lesson form (3.4), the value is credited on the new agreement's first fee.

7.9 For groups and ensembles, 2.5 applies instead of this section.

7.10 For agreements entered into before these Terms where the contracting party has not accepted them, the agreement's previous rescheduling rules apply for as long as the agreement runs (14.4).

§ 8 Termination by notice

8.1 The notice period is two calendar months for both agreement forms — committed and open-ended (3.3) — counted from the day the School received the notice: the agreement ends at the end of the second full calendar month after the month in which the notice was received. If the notice is received on 10 October or 31 October, the agreement ends on 31 December; if it is received on 1 November, it ends on 31 January. The last lesson day is the last day of the notice period, and the fees run up to and including that month.

8.2 A committed agreement can be terminated so that it ends at the earliest on the last day of the commitment period. The notice period is the same as in 8.1: if the commitment ends on 31 August, the notice must have been received no later than 30 June for the agreement to end on 31 August. A notice received in time ends the agreement on the last day of the commitment period — no notice period is added after that day. The School reminds you about 30 days before the last day for notice (3.3). If you want to stop earlier, § 9 applies. For agreements entered into before these Terms, another last day for notice may apply before the end of the commitment period (60 days before the last day of the commitment); it is stated in your agreement confirmation. If the notice is received too late for the agreement to end at the end of the commitment period, it ends at the next possible time under 8.1 — the School shows the date before the notice is confirmed.

8.3 Who gives notice, and how. The contracting party (the person who entered into the agreement) gives notice, and it may be given in any form: in the portal, by e-mail, by telephone or in person at the School's front office. The School recommends the portal or e-mail, because you can then show for yourself when the notice was given. The notice must be given to the School — telling a teacher is not a notice. The notice period is counted from the day the School received the notice; a notice given in the portal counts as received on the day it is registered. The other guardian is informed. The School always confirms the notice in writing with the day of receipt, the last lesson day and the settlement under § 11; if you do not receive a confirmation within a few days, contact the School. If you give notice within the withdrawal period, it is treated as a withdrawal from the agreement (§ 15).

8.4 During the notice period everything continues as usual: lessons are given, fees run and the rescheduling rules in § 7 apply. Lessons you saved yourself must be made up before the last lesson day — those not booked and completed by then count as used in the settlement. This is shown when you give notice: "You have N saved lessons — book them before the last lesson day, otherwise they count as used." Lessons cancelled by the School never count as used — what happens to them is stated in 7.8.

8.5 If the agreement ends as of today (early termination under § 9), today's lesson is given and counts as delivered; the last lesson day is today.

§ 9 Ending early during a commitment period

9.1 The main rule: a committed agreement is paid until the end of the commitment period. The place is yours up to and including the last day of the commitment period, and you can use it right up to that day. If you still want to stop earlier, there are two routes. The School shows both, with amounts, before you choose. You request the termination in the portal; the School carries it out and confirms in writing.

9.2 Route 1 — buying out the agreement. You end the agreement on the day you choose and pay a buy-out fee instead of the remaining monthly fees. The fee consists of three parts:

– The price difference for the months you have had the agreement. A committed agreement has a lower monthly price than an open-ended one. The difference between the open-ended and the committed monthly price is paid for every month the agreement has been used. – Two monthly fees at the open-ended price, corresponding to the notice period (8.1). – The placement fee according to the price list for filling the place again (the School's current value: SEK 2,500; the amount follows the version of the price list).

On a buy-out the agreement ends on the day you choose, shown before you confirm; no notice period is added. The buy-out fee is never higher than the monthly fees remaining up to the last day of the commitment period. The fee is compensation for the School's service and is stated including VAT; the School may reduce it in individual cases. It is charged on the last invoice or charge, and the settlement in § 11 is made as usual when the agreement ends.

Example with the School's current price list, 30 minutes a week: committed agreement SEK 1,419 per month, open-ended agreement SEK 1,639 per month. The agreement is ended when 4 of 12 months have been used. The buy-out fee is 4 × (1,639 − 1,419) + 2 × 1,639 + 2,500 = SEK 6,658, compared with the 8 × 1,419 = SEK 11,352 that would otherwise have remained. The same agreement after ten months used: 10 × 220 + 2 × 1,639 + 2,500 = SEK 7,978, but only 2 × 1,419 = SEK 2,838 remains — the fee is SEK 2,838.

If you have paid a whole agreement year in advance, the fee is calculated in the same way: you are refunded the monthly fees remaining, less the buy-out fee.

9.3 Route 2 — pay out the commitment period. Lessons end on the date you choose, but the monthly fees continue to run until the end of the commitment period. Every fee paid after the last lesson day becomes value on a gift card (§ 13) that the School issues to you: you receive the code when the first such fee has been paid, and the card is valid for twelve months from the most recently paid fee (the School's current value). The gift card can be used for tuition and for books sold by the School, at the price in force at the time. Saved lessons lapse on the last lesson day. You can later switch to route 1 for the fees not yet paid. If the School does not offer gift cards (13.1), only route 1 is available.

9.4 An open-ended agreement is terminated under § 8; no fee for early termination is charged.

9.5 Impediment: moving house or long-term illness. If the student cannot continue because the family moves, or because the student falls ill for a longer period, you may terminate the agreement without a buy-out fee. The notice period in 8.1 applies as usual. The School needs to see supporting documentation: for illness a medical certificate showing that the impediment lasts longer than four weeks, for a move a tenancy agreement, a contract of sale or an extract from the population register. You show the documentation to the School — the School does not keep it, but only notes that it was shown and on what day.

9.6 If the School changes the day, time or place. If the School changes the lesson's weekday, time or premises so that the student cannot take part, you may terminate the agreement without a buy-out fee. Another teacher giving the tuition is not such a change (1.7).

§ 10 When the School terminates the agreement

10.1 The School may terminate the agreement if it can no longer offer any teacher in the subject, if the business closes down, in the event of non-payment or if the agreement is otherwise abused. A termination by the School is always a decision made by a person, with a stated reason — never something that happens automatically, not even in the event of non-payment.

10.2 If the School terminates the agreement it is settled in your favour: you pay only for the lessons delivered, saved lessons do not count as used, lessons cancelled by the School become a credit balance (7.8), remaining fees are stopped, and any surplus becomes a credit balance that you can ask to have paid out (§ 12.3).

10.3 Exception for non-payment during a commitment period: the School is then entitled to the buy-out fee in § 9.2, and the settlement in your favour in 10.2 does not apply.

10.4 A change of teacher or premises is not a termination by the School (1.7).

§ 11 The settlement when an agreement ends

11.1 When an agreement ends — for whatever reason — the School compares, for the agreement year in which the agreement ends, what you have paid with what has been delivered:

– Paid = the sum of the monthly fees you have actually paid for the agreement year. – Delivered = the number of delivered lessons times the lesson value (4.2), plus the value of lessons you saved yourself and did not make up before the last lesson day (8.4). On termination by the School, saved lessons are not counted (10.2). If your price changed during the agreement year (4.3), each lesson is counted at the price in force when it was given. – In addition, the value of lessons cancelled by the School that you have not made up — also from an earlier agreement year — is added as a credit balance (7.8).

11.2 A lesson counts as delivered if the student was Present, if it was an Unreported absence, or if it was a Reported absence that was neither moved nor saved under § 7. A lesson cancelled by the School or the teacher does not count as delivered.

11.3 If paid exceeds delivered you receive a credit balance (§ 12) for the surplus; you may instead request a refund. If delivered exceeds paid, the difference is charged on the final invoice or the last charge. The School shows the calculation, with amounts, before the termination is confirmed. Example with the School's current price list: 30 minutes a week on an open-ended agreement, SEK 1,639 per month, notice given on 10 October with the last lesson day on 31 December; four paid fees (SEK 6,556) against 15 delivered lessons (SEK 7,375.50) and one saved lesson not made up (SEK 491.70) give a final invoice of SEK 1,311. The same agreement with twelve delivered lessons and nothing saved gives a credit balance of SEK 656.

11.4 If you pay by invoice, the agreement year's last fee is invoiced as usual (fee x of 12), and the difference is settled on the final invoice. If you pay by card, the last fee is settled through the settlement.

11.5 The calculation is made in öre; the amount on the invoice is rounded to whole kronor.

§ 12 Credit balance

12.1 A credit balance in kronor arises on your account with the School when a settlement shows a surplus (11.3), when lessons cancelled by the School have not been made up when the agreement ends (7.8), when you have paid too much, and when a gift card is redeemed (§ 13). A credit balance arising from a fee you have already paid is confirmed with a credit invoice. If you pay out a commitment period (9.3) you instead receive a gift card.

12.2 A credit balance is used automatically against your coming fees, oldest first, at the prices in force at the time. A credit balance never lapses. If you still have a credit balance when its validity period ends — twelve months from the day it arose, the School's current value — or when the agreement ends, the School pays the amount out to you (12.3). You are informed 30 days before the validity period ends. Lapsing applies only to gift cards (§ 13) and to what the School has given as a goodwill gesture.

12.3 You may instead request a refund. If the amount was paid by card less than 180 days ago, it is refunded to the card; otherwise the School pays it to a bank account you specify.

§ 13 Gift cards and lesson packages

13.1 Gift cards are bought on the School's website and paid by card. The code is shown once at purchase and sent to the buyer's e-mail address. The gift card is valid for twelve months from purchase (the School's current value) and can be used for tuition and for books sold by the School. It is redeemed in the portal: a family with an agreement receives the value as a credit balance (§ 12); a family without an agreement can buy a lesson package (13.2) with the gift card as payment. The School can also register a redemption on site when you buy books. A gift card can be redeemed in several rounds. Value not redeemed when the validity period has expired is not refunded. The buyer is not a party to any agreement and has no access to the student's information. A gift card issued by the School on early termination (9.3) follows the same rules; it is valid for twelve months from the most recently paid fee.

13.2 Lesson packages are a set number of lessons of a certain length, paid in advance by card or gift card, at the School's open-ended-agreement price in force at the time (the School's current value: no package discount). The lessons are booked in the portal at available times within the package's validity period, which is twelve months (the School's current value). A lesson package is neither a committed nor an open-ended agreement: it has no monthly fees and no notice period, and it ends when the lessons have been taken or the validity period has expired. If you buy the package at a distance you have a right of withdrawal for 14 days from the purchase (§ 15). Lessons not booked and completed within the validity period lapse without refund.

§ 14 Special provisions for agreements entered into before these Terms

This section applies to you who already have a running agreement with the School. From the day this version is published you can accept these Terms in the portal (14.1–14.3); if you do not accept, 14.4 applies.

14.1 What acceptance means. From the day you accept, the rescheduling rules in § 7 apply to your agreement. Your price, your agreement year, your commitment period and your last day for notice before the end of the commitment are not changed by the acceptance.

Credits. Acceptance does not fill any pool: agreements entered into before these Terms have no credits per agreement year (7.3), and a credit is bought when needed (7.4). If the School has decided on credits for your particular agreement, you are told so at acceptance.

The acceptance is a change of Terms on your existing agreement, not a new agreement, and gives no new withdrawal period; your right to leave the agreement ahead of a price adjustment is stated in 14.3.

14.2 Payment method from 1 January 2027. For those who have accepted these Terms, the fees are paid from January 2027 by card, by direct debit (autogiro) or by another automatic payment method that the School offers in the portal, for example Swish; you choose which in the portal. If you choose card, you register the card in the portal, but no charge is made before January: the first charge is made on 27 January 2027 and covers the next fee in your count "fee x of 12", and thereafter the fee is charged on the 27th of each month. If you choose direct debit, you sign the mandate through your bank; no invoice fee is charged, and the direct debit is collected on the due date, the 27th. Until you have chosen a payment method you receive an invoice as today, with an invoice fee of SEK 49 per invoice — also after 1 January 2027. A change of payment method is not a new agreement: the agreement year, the commitment period and the count "fee x of 12" continue.

14.3 Price adjustment. The acceptance contains no price change, and the price of a committed agreement is not changed during the commitment period. A price adjustment is notified to you at least two months before it starts to apply to your agreement: for a committed agreement from the day after the last day of the commitment, for an open-ended agreement under 4.3. If you receive the notice after your last day for notice before the end of the commitment, you may still, within 14 days of the notice, terminate the agreement so that it ends on the last day of the commitment period — the School then accepts the shorter notice period. Until an adjustment starts to apply, the new rescheduling rules apply at an unchanged price.

14.4 If you do not accept, your agreement continues as today: invoices with an invoice fee of SEK 49, your agreement's previous rescheduling rules — a lesson can be moved to a new time no later than 14 days before the start; closer than that it counts as used; lessons cannot be saved and there are no credits — and your price. These Terms do not start to apply to your agreement until you have accepted them with BankID in the portal. The School may remind you that they exist, but no time limit makes them apply by itself.

What you cannot do without having accepted the Terms currently in force is manage your agreement yourself in the portal: rescheduling and make-up lessons, breaks, changing course and buying credits all require accepted current Terms. If you want to use the self-service, you accept the Terms in the portal. Your price changes only under § 4.3 and 14.3.

14.5 If the student has two guardians, the one who is the contracting party accepts; the other is informed.

§ 15 Right of withdrawal and cancellation before the start

15.1 Right of withdrawal. When you enter into the agreement at a distance — on the website or by accepting an offer in the portal — you have, under the Swedish Act on distance contracts and off-premises contracts, the right to withdraw from the agreement within 14 days from the agreement date, that is the day you accepted the Terms. Fourteen days is the School's current value; if the School states a longer withdrawal period for your agreement type, the longer period applies. The number of days is always stated in the offer and in your agreement confirmation. The School applies the right of withdrawal to all agreement types under these Terms, including lesson packages (13.2).

15.2 How to withdraw. Tell the School in any form that you withdraw from the agreement — through the portal, by e-mail to info@malmomusikskola.se, by letter or by telephone. You may use the Swedish Consumer Agency's standard form (Appendix A), but you do not have to. It is enough that the message is sent within the period. The School confirms receipt in writing.

15.3 Tuition during the withdrawal period. When entering into the agreement you may expressly request that tuition begins already during the withdrawal period; this is a separate choice that is not pre-selected. If you withdraw after such a request, you pay for the lessons delivered up to and including the day you withdrew (the number of lessons times the lesson value), and the rest is refunded. If you have not requested a start during the period, everything you have paid is refunded. The refund is made within 14 days from the day the School received your message.

15.4 When the right of withdrawal does not apply. (a) A trial lesson (§ 5) is given on a set day and time — no right of withdrawal applies to the purchase, which is stated before you pay. (b) If you accept an offer in the portal, the agreement is entered into at a distance even if you have visited the School beforehand, and the right of withdrawal applies. If the School offers that you instead accept on the School's premises, and you do so on the same day the offer was made, the agreement is not a distance contract and no right of withdrawal applies — this is stated clearly before you accept. (c) For an agreement type where the School invokes the Act's exception for leisure activities during a specific period, it is stated clearly when you sign up that no right of withdrawal applies, together with the basis; the service period is then the one stated in 3.2. All of the School's current agreement types carry a right of withdrawal.

15.5 Cancellation after the withdrawal period but before the first lesson. If the withdrawal period has expired, you can still cancel the agreement at no cost up to and including 14 days before the first lesson (the School's current value). No lessons are counted, no fee is charged and a first fee already paid is refunded. If you cancel less than 14 days before the first lesson, termination under § 8 applies, and for agreements with a commitment period § 9.

§ 16 Messages from the School

16.1 The School sends notices to the contracting party's e-mail address, and by SMS where you have chosen this and confirmed your mobile number: confirmation when the agreement is entered into (with these Terms, a summary of price, commitment period and notice period, and the withdrawal form), an offer from the School and a reminder before it expires (2.7), an offer of an agreement after a trial lesson (5.2), a reminder about 30 days before the last day for notice before the end of the commitment, notice of a price change (4.3, 14.3), notice when new Terms have been published and can be accepted in the portal (§ 18), payment reminders, confirmation with the day of receipt, the last lesson day and the settlement when the agreement ends, the gift card code (§ 13), and a notice 30 days before a credit balance's validity period ends and the amount is paid out (12.2). An offer from the School and the reminder about it are also sent by SMS to the mobile number you gave the front office, once the School has SMS messaging. Notices about lessons that are cancelled or moved are sent according to the School's notification settings in the portal. Keep your contact details up to date in the portal.

16.2 Messages from the School never contain the reason for an individual person's absence. A lesson cancelled because the teacher cannot give it is labelled "Teacher absence".

§ 17 Personal data

17.1 The School is the data controller for the data processed in Kadensa for your agreement. The data are processed to enter into and perform the agreement: schedule, attendance, payment, messages and contact.

17.2 Card payment. To the payment provider Stripe the School passes your name, your e-mail address, your postal code, the amounts and the platform's internal references for the agreement. The postal code is used to verify the card. You provide the card details directly to Stripe; the School never sees or stores the card number. Personal identity number, date of birth and the child's name are never passed to Stripe. Stripe processes these data partly as the School's data processor and partly as an independent controller for the payment itself and for preventing fraud, under Stripe's data processing agreement. Data may be transferred to Stripe's companies in the USA; the transfer is protected by the EU standard contractual clauses in Stripe's data transfer annex.

17.3 Invoice and direct debit. To the School's invoicing system Fortnox are passed name, invoice address, amount, VAT and which fee in the agreement year the invoice concerns. Fortnox processes the data as the School's data processor under its data processing agreement, with the sub-processors Fortnox lists; if data are transferred outside the EU/EEA, this is done with the protection required by the General Data Protection Regulation.

17.4 How long the data are kept. Financial records — agreements, invoices, payments and acceptances of Terms — are kept for seven years under the Swedish Accounting Act. Other agreement data, such as requests and saved lessons, are kept for twelve months after the agreement has ended. An enrolment that did not lead to an agreement is deleted after 30 days; the same applies to data on a person registered for an offer from the School (2.7) that did not lead to an agreement, 30 days after the offer lapsed (the School's current value). A gift card buyer's name and e-mail address are deleted twelve months after the gift card was redeemed or expired.

17.5 Your rights. You have the right to obtain the data the School holds about you and the student, to have incorrect data corrected and to request deletion. Financial records that the law requires the School to keep are anonymised instead of deleted, and are deleted when the seven-year period has expired. Contact the School at info@malmomusikskola.se.

17.6 In a credit check — before payment by invoice under an offer (2.7) or on a change of contracting party (3.5) — the School stores only whether it was approved or declined and when; never the content of the check.

17.7 Requests in the portal (termination, change, refund) consist of a choice and a date, without free text. If you write to the School by e-mail to accept or terminate an agreement, the School keeps the message as evidence, protected and accessible only to the School's administration.

17.8 The School identifies you with BankID through the provider Idura; your personal identity number is stored to link the login to the agreement. BankID is used for login and for accepting Terms.

17.9 The student's personal identity number is provided at enrolment. The School needs it to tell students apart in its records, for attendance and certificates, and to link the student to the right guardian. If the student has no Swedish personal identity number, the date of birth and the number of an identity document from another country are provided instead.

§ 18 Changes to the Terms

18.1 These Terms have a version number and a date. Your agreement always refers to the version you accepted, and a published version is never changed afterwards.

18.2 New Terms apply to new agreements. When the School publishes a new version, it applies to agreements entered into thereafter, and to you if you enter into your agreement anew. Your running agreement continues on the Terms you have accepted until you accept the new ones in the portal with BankID — the Terms are never changed by a notice or by a time limit running out. The School shows the new Terms in the portal together with a summary of what is changing, so that you can read them and decide in your own time; you may postpone the decision. Managing the agreement yourself in the portal does, however, require accepted current Terms (14.4). An acceptance never in itself changes your price, your agreement year or your commitment period — price changes follow § 4.3.

18.3 The version you accepted, and when it started to apply to your agreement, is always available in the portal. The Terms are available in Swedish and English. In case of any discrepancy, the Swedish text prevails.

§ 19 Questions, complaints and disputes

19.1 Questions about the agreement are addressed to the School at info@malmomusikskola.se.

19.2 If you are not satisfied with how the School has handled a complaint, you may turn to the Swedish National Board for Consumer Disputes (Allmänna reklamationsnämnden, ARN), Box 174, SE-101 23 Stockholm, arn.se, which examines disputes between consumers and businesses. The School takes part in ARN's proceedings and follows the Board's recommendations. You may also turn to a general court.

Appendix A — Standard withdrawal form of the Swedish Consumer Agency: the form is attached to your agreement confirmation and is available in the portal.
